Viral Concept Challenge Terms & Conditions

Participation in the Viral Concept Challenge (“Challenge”) organized by Coda Platform Ltd. (“Coda”) is subject to your agreement to the following terms:

The Challenge: Coda welcomes all studios/developers to submit a hyper-casual game plan to showcase what they envision. The game plan must be based on a social media trend and must include a link to the reference video and details about mechanics, art style, level progression. There is no limitation to what type of social media platform you can get inspiration from or the engagement level of the reference video. 

The developers whose submissions are accepted will be invited to the second stage where they will enter into a close collaboration for focused personalized guidance to produce 5 optimised gameplay videos (a.k.a creatives), game assets (4 x screenshots and icon) to be tested on Coda’s dashboard. 

  1. Conditions.
    (i) There is no game submitted to or published in the App Store or Google Play Store with identical or substantially similar gameplay and artstyle to a Submission; (ii) A Submission (or another substantially similar version or game) is not currently or was not previously submitted to or presented to any other third party publisher by you; and (iii) A Submission is delivered as required within the Challenge timetable and is approved by a publishing manager.
  2. Timetable.
    The Challenge will open for Submissions on 15/03/2021. You may submit your game plan until 23/04/2021.
  3. Success & Payment Terms.
    If a Submission meets the conditions and is approved for testing by a publishing manager you will be entitled to a one-time payment of $1000. The payment will be made to your account within 30 days once you complete the second stage which requires the developer to upload 5 gameplay videos and game assets (4 x screenshots and icon) to the Coda Dashboard with guidance from the publishing team.

    The test will be run in the US market for 24 hours and the results of the best creatives will be transparently shared on the Coda Platform. If the best performing creative achieves the applicable success KPI (35+ IPM -install per thousand-), and you want to continue working on the applicable game, you will enter into a publishing agreement with Coda on an exclusive basis for the said concept, in which event you will be entitled to a payment of $10.000 within 30 days upon signing of the publishing agreement. The details of the publishing deal will be discussed at this stage.

    If a Submission fails to achieve the applicable success KPIs, you may be free to show it to any person and to take any action with respect thereto. You may withdraw from exclusivity under the terms of the publishing agreement only after six (6) months of full commercial release of the game or after it is finally abandoned by Coda, whichever is earlier, notwithstanding anything to the contrary in the publishing agreement, and to this extent these terms will prevail. 

  4. Term:
    These terms are effective as of the date you sign them and continue until terminated by written notice by Coda.
  5. Confidentiality:
    All information relating to the Challenge, Submissions and the Coda Dashboard (including discussions relating thereto), and all other confidential or proprietary knowledge, data, information or material furnished to you or to which you are exposed as a result thereof, constitute Coda’s confidential information, and you agree to hold same in strict confidence and not publish, disclose or otherwise make it available to others, and not use it except for the performance of these terms.
  6. Representations and Warranties:
    You represent and warrant that: (i) you have full legal authority to enter into these terms and form a binding agreement with Coda; (ii) you are the sole owner or licensor of your Submissions; and (iii) the Submissions do not infringe any law or third party rights or give rise to any third party legal claim.
  7. Law:
    These terms are governed by UK law, excluding its conflict of law rules, and you hereby agree to submit to the personal and exclusive jurisdiction of the courts located in London.
  8. General:
    These terms supersede all prior agreements signed between you and Coda related to the subject matter hereof. If a section hereof is held invalid or unenforceable by a competent court, it will not affect the validity of the other sections and will be substituted with a valid and enforceable one which most closely approximates the original section.
